Biography: Professional Experience Diane Calta is an associate with Walter Haverfield and a member of its Public Law group. Her practice encompasses a wide variety of disciplines including municipal law, litigation, real estate, and probate and estate planning. Diane previously served as Assistant Director of Law for several Northeast Ohio communities and as the Assistant Prosecutor for the Village of Bratenahl. In addition, she was a victims' coordinator in the domestic violence division of the St. Joseph County (Indiana) prosecutor's office. Diane also has several years' experience representing the interests of corporate clients on various issues. Received $990, 000 settlement in franchise renewal and copyright infringement lawsuit. •Negotiated easements with numerous private and public property owners to acquire rights to construct a $1 million public hike and bike trail in local village pursuant to a federal grant awarded by NOACA and administered as an LPA project through ODOT. •Advised local village on the process to construct a new $4 million police station as a design-build project and prepared all necessary agreements, proposals, and ordinances. •Experienced in negotiating agreements to facilitate economic development, including but not limited to TIF agreements and ordinances. •Conducted multiple eminent domain proceedings in Cuyahoga and Summit County Probate Courts to acquire right-of-way for roadway projects, as well as to facilitate economic development and secure recreational green space. •Served as Assistant Director of Law for Mayfield Village, Chagrin Falls, Bentleyville, and the City of Macedonia. •Served as Assistant Prosecutor for the Village of Bratenahl. •Negotiated purchase agreement and land reconfiguration with large corporate landowner for donation of land to the Cuyahoga County Public Library for the construction of new library in local village. •Represented municipal clients at Council, Planning Commission, and Board of Zoning Appeals meetings. •Drafted legislation. •Advised mayors and other municipal officials and public employees on a day-to-day basis. •Research and draft legal opinions on municipal issues, including but not limited to planning and zoning, public records laws, storm water compliance issues, competitive bidding, assessment equalization boards, and eminent domain. •Represented municipal clients in litigation in state and federal courts. •Negotiated and drafted contracts, agreements and other documents on behalf of the above communities, including real estate purchase agreements and options to purchase, leases, easements, and economic development agreements. •Represented municipal clients and public employees in civil service and employment matters. Litigation•Litigated age discrimination matters. •Litigated administrative appeal of local City Board of Zoning Appeals denial of variance. •Received $1.6 million jury verdict as co-counsel on behalf of landlord. •Received $285, 000 jury verdict as co-counsel on behalf of residential property owner in eminent domain case. •Received $110, 000 verdict as co-counsel on behalf of former employee in an ERISA violation case. •Argued all aspects of appeals before the Sixth Circuit, Ohio Supreme Court, and various Ohio appellate courts. •Presented oral argument to the Ohio Supreme Court concerning the constitutionality of the Ohio DUI seizure statute. •Prepared and submitted Writ of Certiorari to the United States Supreme Court in First Amendment/Adult Entertainment Zoning case. Real Estate law•Received a $700, 000 jury verdict on behalf of a property owner whose land was harmed by an upstream owner/developer's failure to follow best management practices. •Represented national conservation organization in the acquisition of the former Acacia Country Club property and the subsequent donation of same to the Cleveland Metroparks. •Advised clients and prepared necessary documents pertaining to residential and commercial real estate transactions, including purchase agreements, leases, options to purchase, and deeds. Estate Planning and Probate Law•Successfully defended claim against trustee, from magistrate level through appeal to the Ohio Supreme Court. •Served as court-appointed guardian and trustee for suit. •Advised clients in the preparation of estate planning documents. •Advised clients on general estate planning and guided them through the probate administration process. •Drafted and executed wills, durable powers of attorney, living wills, and durable healthcare powers of attorney. •Drafted and executed various forms of trusts, including, but not limited to living trusts, irrevocable trusts and special-needs trusts.
